Terms of Service

Terms of Service

Effective date: January 1, 2025

1) Overview

By using our site or purchasing from us, you agree to these Terms and our other policies incorporated by reference (Return & Refund, Shipping, Privacy, and Financing). We sell and ship within Canada. By ordering, you confirm you are of the age of majority in your province or territory and a Canadian resident.

2) Contact

All communications with KANE Forged must be initiated through the Contact page on our website. Submit your message through the form provided; we will respond using the contact details you provide. This is our sole method of customer communication.

3) Product information & pricing

We aim for accuracy, but errors may occur. We may correct errors, change or update information, and cancel orders (with a full refund) before shipment if an error materially affects your order. Unless stated otherwise, prices are in CAD. Applicable taxes and shipping are shown at checkout. Color/finish appearance can vary due to lighting, screens, and the nature of custom finishing.

4) Orders & acceptance

Orders placed through our site are offers to purchase. We accept only when we issue an Order Confirmation. Your order details and these Terms are accessible on our website and included in your order confirmation email.

5) Fitment, use & installation

We provide general fitment guidance only; you are solely responsible for verifying fitment for your specific vehicle and modifications (brakes, suspension, tires, spacers, camber, hub hardware, TPMS, etc.). Use of aggressive/atypical setups (e.g., stretched tires, extreme camber, spacer stacks) is at your own risk and may void warranties.

Installation must be performed by a qualified professional using proper torque, hub-centric rings where needed, and manufacturer-approved hardware. Re-torque after 50–100 km and at regular service intervals. We are not liable for costs arising from installation, mounting/balancing, alignment, tire damage, or resulting vehicle damage except where required by law.

6) Custom / made-to-order (MTO)

Custom/MTO items are built to your specification. After we release your order to machining/finishing, it becomes non-cancellable and final sale. Lead times are estimates and can vary due to capacity, finishing queues, and logistics.

7) Inspection on delivery

Open and visually inspect wheels upon delivery while keeping all packaging. Do not bolt wheels to the vehicle for test-fitting and do not place bare faces on hard surfaces. Report any visible defects, shipping damage, or shortages with clear photos within 2 business days of delivery. Once tires are mounted or installation marks are present, the product is considered used and no longer eligible for a return except as required by law.

8) Motorsport/track use

Track/competition use or other high-stress applications are at your own risk and may void warranties.

9) Shipping, delivery & risk of loss

Shipping methods, fees, and estimated timelines are described in our Shipping Policy. Title and risk of loss transfer upon the carrier’s confirmed delivery scan to your address. Delivery timelines are estimates; we are not liable for delays outside our control (carriers, customs, weather, strikes, force majeure).

If an order’s fulfillment window exceeds 30 days (common for MTO), any installment payments (if selected) may come due before delivery.

10) Returns, refunds & warranty

Returns, exchanges, and warranty processing follow our Return & Refund Policy (incorporated by reference) and any Limited Warranty posted on our site. Where a conflict exists, your non-waivable statutory rights prevail. Custom/MTO products are generally final sale.

11) Financing & installments (Shop Pay Installments, powered by Affirm)

We may offer Shop Pay Installments for eligible Canadian orders. Key points:
• Eligibility & amounts. Subject to approval by Affirm; typical eligible order sizes range from $35 to $30,000 CAD (including taxes/shipping). Options depend on cart amount and approval.
• Plans. Offers may include bi-weekly interest-free or monthly installments; available plan types vary by order size and approval.
• Rates. 0–31.99% APR, subject to provincial regulatory limits. A down payment (or a payment due today) may be required.
• No late fees. Affirm states it does not charge late fees for Shop Pay Installments.
• Credit reporting. Your loan and repayment activity may be reported to credit bureaus by Affirm.
• Servicing. The loan is issued/serviced by Affirm; payments are made to Affirm under your loan agreement. If interest applies, it is a cost of borrowing and may not be refunded on returns; see our Financing page and your loan agreement.
• Long fulfillment. For MTO orders with lead times over 30 days, one or more installment payments may fall due before the product ships.

For full details, see our Financing page (incorporated by reference) and the Affirm documentation linked there.

12) Chargebacks & fraud

We investigate and contest chargebacks on policy-compliant transactions. We may refuse, cancel, or limit orders suspected of fraud or abuse and may share information with payment providers and law enforcement as permitted by law.

13) Limitation of liability

To the maximum extent permitted by law, KANE Forged is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of use, mounting/balancing/alignment/towing costs, or lost profits. Our total liability for any claim relating to a product is limited to the amount you paid for that product. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14) Intellectual property

All site content, product designs, images, and marks are owned by KANE Forged or its licensors. No rights are granted except as required to use the site and place orders.

15) Governing law & venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Toronto, Ontario have exclusive jurisdiction over disputes, subject to any non-waivable venue or consumer-protection rights available to you in your province or territory.

16) Changes to these Terms

We may update these Terms. The latest version is posted on this page and applies from its effective date. If material changes affect existing orders, we will notify you and apply changes only as permitted by law.
